We are currently experiencing an extremely high volume of orders at our warehouse, and a longer delivery time for shipments with PostNord must be expected. We apologize for this and are working hard to ensure that you receive your order as quickly as possible!

 

1) Definition of Parties

The seller is Porsgrunds Porselænsfabrik AS (Org. No.: 915 232 523), Pustutveien 18, Postboks 14, 1396 Slependen, hereinafter referred to as the seller, we, or us. Porsgrund Porselen is currently part of the 3-Norske group.
The buyer is the person specified as the buyer in the order, and is hereinafter referred to as the customer, buyer, you, or your.

2) General Terms and Conditions

These terms of purchase apply to the purchase of goods and services from www.porsgrund.com and its subpages.
The terms of purchase and your order, confirmed by order, constitute the overall contractual basis for the purchase. Consumer purchases are regulated by, among others, the Consumer Purchase Act, the Right of Withdrawal Act, the Marketing Act, the Personal Data Act, the E-commerce Act, and the Credit Purchase Act.
If you are under 18 years of age, parental consent is required. Goods from the online store can generally only be ordered for delivery in Norway. Delivery outside the country's borders must be agreed upon with customer service.
All prices are stated including VAT and excluding shipping, unless otherwise specified. The total cost will be displayed before the order is placed and will include all expenses associated with the purchase. We reserve the right to refuse delivery of all goods based on typographical errors, incorrect pricing, competitive conditions, and all other reasons.

3) Payment

The customer chooses the payment method. Payment is processed by qualified providers, namely Klarna Norge AS and Nets Branch Norway, which are secure electronic payment providers for Visa and MasterCard/Eurocard.
All information entered into Klarna Checkout or Nets, both personal data and card information, is encrypted and secured according to the highest standards. All card information is stored in accordance with the card companies' regulations. As an end customer, you can be completely confident that your information will never be compromised and will never be shared with third parties. We require payment for the item from the time it is shipped from us to the customer.

4) Delivery and Delay

Shipment with PostNord. Shipments only in Norway. PostNord normally delivers within 2-5 working days. During peak season, a somewhat longer delivery time should be expected. Shipping costs from NOK 59 to NOK 149 are to be paid by the customer, unless otherwise specified at the time of payment. All prices will be stated during the purchase process.

Shipment with PorterBuddy. PorterBuddy offers same-day delivery in Oslo and surrounding areas (Postcodes 0000 - 3472), and delivers the next day in Stavanger (Postcodes 4000 - 4365), Kristiansand (Postcodes 4608 - 4790), Bergen (Postcodes 5003 - 5355) and Trondheim (Postcodes 7010 - 7563). Order on weekdays before 11:00 AM to have your package delivered directly to your door, shipping cost NOK 99.

Note! If you do not see PorterBuddy as a delivery option at checkout, they unfortunately do not deliver to the postcode you have entered in your delivery address. 

 

Once the package has been sent, you will receive a confirmation by email. The package must be picked up at your delivery point within 7 days before it is returned to us. If the package is not picked up at the agreed location and the customer requests a new delivery, costs associated with the new shipment will generally be borne by the customer.
Unclaimed packages will be charged a fee of NOK 150. This is to cover all costs for shipping to and from, handling, and packaging. The customer is responsible for providing the correct address and mobile number so that we can notify you when the package is ready for delivery. The mobile number provided must be a Norwegian number.

If an item is out of stock, the remaining items will be sent and the missing item(s) will be credited. The customer will receive a confirmation email for this credit.

6) Responsibility and Examination of Products

The risk for the products is transferred to the customer as soon as they are in the customer's possession. After the customer has received the goods, the delivery should be examined as soon as possible to ensure that: the shipment is in accordance with the order confirmation, whether the products have been damaged during transport, or have other errors/defects.

7) Exchange/Right of Withdrawal

According to the Right of Withdrawal Act, the right of withdrawal applies for 14 days from the day the buyer received the item (with us, this has been extended to 30 days). If you wish to exercise your right of withdrawal, the item must be returned in the same condition as it was received. Once the return is approved, you will be refunded the applicable amount for the item(s). Original shipping costs will not be refunded.

Returns must be made with PostNord; follow the return link attached to the shipping confirmation, or in the PostNord app.

8) Complaints

If there is a defect in the item, notification must be given by email within a reasonable time, with the order number and a picture. The customer will then be guided on how to proceed with the complaint. The rules regarding complaints are found in the Consumer Purchases Act.

During holiday periods, processing times may be longer than usual. This especially applies to weeks 27, 28, 29, and 30. The same applies in January, weeks 1-5.

9) Reservations

We strive to provide our customers with information as accurate as possible, but we reserve the right for spelling/printing errors.
In case of out-of-stock situations, we reserve the right to cancel all or parts of an order. In such situations, we will do our best to find alternative solutions. The customer will have the opportunity to accept a new offer with respective changes or cancel the order.
Images used on our pages are illustrative and may differ from the actual appearance of the product.

We reserve the right not to deliver to Svalbard and Jan Mayen.

10) Personal Data and Other Information

We are very committed to ensuring that personal data is handled securely. Primarily, we only process data necessary for us to fulfill our obligations to the customer. In connection with accounting, tax handling, and return/warranty handling, we are obliged to store, among other things, name, address, and email. Credit card numbers are handled by a qualified payment service provider. Purchase history and log data are used to learn more about what our customers are interested in, as well as to improve offers and selections. Porsgrunds Porselænsfabrik AS does not sell personal data to third parties, and all information is handled confidentially. We process personal data in accordance with the Personal Data Act.

We offer communication via email and SMS. Receiving this is voluntary, and you can easily unsubscribe at any time via My Page or by contacting us. We reserve the right to send material by post to registered customers.

11) Customer's Responsibilities

As a customer, you are responsible for paying for the services provided by the seller in accordance with the applicable terms. This responsibility also covers unauthorized use by others, unless it can be proven that this was enabled through negligence on the part of the seller.

12) Changes to the Terms

The seller reserves the right to amend these terms.

13) Extraordinary Circumstances

The seller is not liable for indirect losses resulting from defects unless the loss is caused by gross negligence or intent on the part of the seller.

14) Force Majeure

If delivery or redelivery is unreasonably burdensome due to labor dispute or any other circumstance beyond the parties' control, such as fire, war, mobilization or unforeseen military call-ups of similar scope, requisition, seizure, currency restrictions, rebellion and riots, shortage of means of transport, general shortage of goods, as well as defects in or delays of deliveries from subcontractors or producers due to such circumstances as mentioned in this point, the seller is exempt from all other liability than in cases of complaints and will credit the purchase price corresponding to the defective item.

15) Copyright

All content on www.porsgrund.com belongs to Porsgrunds Porselænsfabrik AS or a subcontractor of the aforementioned property, and is protected under, among others, copyright, marketing, and trademark legislation. This means that all information, design, images, and graphics cannot, under any circumstances, be downloaded, copied, or used without specific written prior consent from Porsgrunds Porselænsfabrik AS.

16) Disputes

The parties shall attempt to resolve any disputes amicably. If this is not successful, the matter may be brought before the Consumer Council in accordance with Norwegian law.
